Terms of Use

These Terms of Use govern your use of the Ovation Point website, forms, workshops, and programs, including The 90 Day Push and the Finish Strong Workshop. They are an agreement between you and Ovation Point LLC ("Ovation Point," "we," "us").

Client engagements are governed by a separate written agreement. Nothing on this site creates a client, advisory, or employment relationship on its own.

1.Accepting these terms

By using this site, submitting a form, or registering for a workshop or program, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the site. You must be at least 18 to use our services. If you use them on behalf of an organization, you confirm you are authorized to accept these terms for it.

2.Using the site

You may use this site for lawful business and personal purposes. You agree not to:

• Submit false, misleading, or someone else's information.
• Interfere with the site, its security, or its forms, or try to gain unauthorized access to any system behind it.
• Scrape, copy, or republish our content at scale, or use it to train automated systems, without written permission.
• Use the site to send spam or to harass, impersonate, or harm anyone.

3.Engagements and advice

Submitting a qualification or expert request form starts a conversation; it does not obligate either of us to an engagement. Program delivery, staffing, assessment, and advisory work begin only when both parties sign a written agreement, and that agreement controls if it conflicts with these terms.

Content on this site, in workshops, and in our published materials is general information. It is not legal, financial, tax, or compliance advice for your specific situation. Decisions you make based on it are your own.

4.Workshops and purchases

• Prices, inclusions, and dates are shown at the time you register or buy, and the terms presented at checkout apply to that purchase.
• We may reschedule or cancel a session. If we cancel a paid session and do not offer a replacement, we will refund what you paid for it.
• For any question about a charge or refund, contact us at the email below before disputing it with your bank, so we can resolve it quickly.
• Workshop recordings and materials are for your own use. Please do not share login links or redistribute materials.

5.What you send us

You keep ownership of anything you submit, such as articles, interview answers, form responses, and workshop worksheets. You confirm you have the right to share it.

If you submit an article or agree to an interview for publication, you give us a non-exclusive, royalty-free license to edit it for length and clarity, publish it, and promote it with your name and likeness. We will not publish it until you approve the final version.

Please do not send us confidential information through the website forms. If an engagement requires it, we will set up an appropriate channel under the written agreement.

6.Our content

The site, its design, text, graphics, frameworks, workshop materials, and the Ovation Point name and marks belong to Ovation Point or its licensors and are protected by law. You may view and share links to our pages. Any other use, copying, or adaptation needs our written permission.

7.Third-party links and tools

Our forms, booking, email, and video tools are provided by third parties, and the site may link to outside websites. Those services have their own terms and privacy practices, and we are not responsible for their content or availability.

8.Disclaimers

The site and its content are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the site will be uninterrupted or error-free, or that any particular result will follow from using our content or attending a workshop.

9.Limitation of liability

To the fullest extent the law allows, Ovation Point will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the site or its content. Our total liability for any claim related to the site or a workshop purchase will not exceed the greater of the amount you paid us for that workshop or one hundred U.S. dollars ($100). This section does not limit liability under a signed client agreement, which sets its own terms.

10.Indemnity

You agree to defend and hold harmless Ovation Point and its team from claims, losses, and expenses, including reasonable attorneys' fees, arising from your misuse of the site, content you submit, or your violation of these terms.

11.Governing law

These terms are governed by the laws of the State of Michigan, without regard to its conflict-of-law rules. Any dispute related to them will be brought in the state or federal courts located in Michigan, and you consent to their jurisdiction. If any part of these terms is found unenforceable, the rest stays in effect.

12.Changes

We may update these terms. When we do, we will change the effective date above. Continuing to use the site after an update means you accept the revised terms.
